WHITEHOLE — Terms of Service

WHITEHOLE (whitehole.io) is a music streaming and download service operated by SAAAD LABS LLC, 3443 JFK Blvd, Unit 201, Jersey City, NJ 07307 ("WHITEHOLE", "we"). By creating an account or using the service you agree to these terms.

1 · The service and its pricing

FREE TIER — $0. Streaming with a registered account.
PATRON TIER — $20.00 / month. Streaming plus supporter benefits as announced.
DOWNLOADS — $0.99 per track. Permanent; yours to keep.
WALLET — $10.00 adds ten dollars of purchase credit. Credits buy tracks at the listed price with no per-purchase card fee.

Prices are stated in U.S. dollars and may change prospectively with notice; a change never affects tracks you already purchased or credit you already hold. The service is offered in the United States. During the pre-launch period, access is by invitation.

Single tracks are purchased with wallet credit. Card checkout is available for three or more tracks in one order — we do not run a lone $0.99 card charge, because card processing fees would make that transaction a loss and the price would have to rise to cover them. The wallet exists so the listed price is the whole price.

2 · Accounts

There are two account types and they do not overlap: listener accounts (streaming, purchasing, a profile and a purchase library) and artist accounts (uploading and earnings, governed additionally by the WHITEHOLE Uploader Agreement). Registration creates a listener account. Keep your password to yourself; you are responsible for activity under your account. You must be at least 13; if under 18, use the service with a parent or guardian involved.

3 · Purchases are permanent

When you buy a download, you keep it. Your purchase is recorded to your account and you may download it again at any time at no charge, including offline use. This permanence survives changes to the catalog: if an artist withdraws a track from streaming, your purchased copy remains yours. It does not expire with any subscription and is not conditioned on one.

4 · Payments, cancellation, refunds

Payments are processed by Stripe; your card details go to Stripe directly and are never seen or stored by WHITEHOLE. The Patron subscription renews monthly until cancelled; cancel any time (Account → Manage Subscription) and it ends at the close of the paid period — no further charges, no partial-month refunds. Because downloads are delivered immediately, download purchases are final once delivery succeeds, except where a purchase fails to deliver (we fix it or refund it) or where the law requires otherwise. 4a · The wallet

Wallet credit is prepaid purchase credit for this service: it buys tracks at their listed price, does not expire, earns no interest, and is not transferable to another account or redeemable for cash except as described here or required by law. Your balance and its full history are visible in your Account. If you have unspent credit you no longer want, we will refund it to your original payment method on request at contact@saaadlabs.com while your account is in good standing. Credit already spent on a delivered track is a completed purchase under section 4.

5 · What you may not do

Do not redistribute streams, circumvent access or territory controls, scrape the catalog, automate plays, share account credentials, or use the service to infringe anyone's rights. Streams are licensed for your personal listening; purchased downloads are licensed for your personal, non-commercial use.

6 · Copyright

We respond to copyright notices under 17 U.S.C. §512 — the process and our designated agent are published at whitehole.io/dmca.html. Accounts that repeatedly infringe are terminated. That policy is real and enforced.

7 · Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms, with the repeat-infringer policy above applied as written. If your account is closed, section 3 survives for purchases already made to the extent we are lawfully able to continue offering re-download.

8 · Disclaimers and limits

The service is provided as-is; we do not promise uninterrupted availability. To the extent permitted by law, our aggregate liability to you is limited to the amounts you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

9 · Changes, law, contact

We may update these terms prospectively; material changes will be announced in the service with reasonable notice, and continued use after the effective date is acceptance. These terms are governed by the laws of the State of New Jersey, with disputes in the state or federal courts located in New Jersey. Questions: contact@saaadlabs.com.
